TERMS & CONDITIONS

I. INTRODUCTION

1. These are the Terms and Conditions governing the use of this website www.gora.eco and regulate the relations between GORA PROJECT EOOD, registered VAT number BG206622541, with its registered address at Sofia, Bulgaria, 32 Ostrets str. called “The Company” and the customers using the online store - "User (s)".

2. The acceptance of these General Terms and Conditions by the Users is a mandatory condition for the exclusion of a contract of sale between the Company and the Users.

3. By clicking on the button "I agree with the General Terms and Conditions", the User declares that he has read and understood these General Terms and Conditions, agrees with them, accepts them without remarks and reserves the right to comply with them.

4. The General Terms and Conditions are mandatory for all Users. The company reserves the right to unilaterally.

II. USERS OBLIGATIONS

5. Users give their consent and declare that when using the online store www.gora.eco will provide correct, accurate, current and complete information when filling out the registration form. The Company is not responsible for incorrect/incorrectly executed order in connection with incorrect, inaccurate, incomplete and outdated information declarated by the Users.

III. PERSONAL DATA

6. The company is a personal data administrator according to the Personal Data Protection Act.

7. By accepting these General Terms and Conditions, the User gives his indefinite explicit and unconditional consent to the personal data provided by him to be collected, stored, processed and used by the Company for the purposes of the contract for purchase - sale and delivery of ordered products.

8. The company guarantees to its users the confidentiality of the provided information and personal data. The information will not be used, provided or brought to the notice of third parties except in the cases and under the conditions specified in these General Terms and Conditions.

9. The Company protects the personal data of the User.

10. In compliance with these General Terms and Conditions, the Company may use the personal data of the User only for the purposes provided in the contract. Any other purposes for which the data is used will be in accordance with the Bulgarian law, the applicable international acts, the Internet ethics, the rules of morals and good manners.

11. The Company obliges not to disclose any personal data about the User to third parties - government agencies, companies, individuals, etc., except in cases where it has received the written consent of the User; the information is requested by state bodies or officials, who according to the current legislation are authorized to request and collect such information. In these cases the Company is obliged to provide the information by law.

12. According to the Personal Data Protection Act, the User has the right to access his own personal data, which he has entered and/or become available to the Company when using the site, as well as for the purposes of correction of the provided personal data.

IV. PRODUCTS AND SERVICES ON THE WEBSITE

13. The online store goraclothing.com offers a diverse range of products.

14. Each product on the site is provided with information about the price, main characteristics and additional information aimed at supporting the making of an informed choice by the User when purchasing the product.

16. The Company reserves the right to change at any time and without notice the published information on the website, including information relating to products, services, prices and characteristics of the products. Users are considered informed of these changes and the changes take effect from the date of publication. It is possible that at the time of placing the order some of the information on the site is out of date or the availability of goods is out of stock. In all these cases, the User will be informed over the phone or e-mail address provided by him.

17. All prices listed on the site are in Bulgarian levs and include VAT. The value of postage/transport costs related to the delivery is charged at the end of each order and is explicitly stated before confirming the order.

18. For each product offered on the site, the regular price of the product is indicated, without discount.

19. In the cases when for certain goods offered on the site there is a reduction from the regular price at which the goods are offered, along with its regular price, the respective reduced price shall be indicated, as well as the term for which the goods will be reduced, not exceeding 1 calendar month.

V. CONDITIONS FOR PURCHASE

20. The user has several shopping options on the online store www.gora.eco

- To register with a username and password. Registration is completely voluntary and free.

- Select the "Order" option - in this case the User must fill in his personal data, delivery details and payment method.

- To select the option "Quick order" - in this case the User must enter his phone number and email address.

21. The user should enter up-to-date, correct, complete and accurate data, otherwise he is responsible for the incorrect execution of the order.

22. The user has the right at any time after registration to change the entered data, except in the case of an order confirmed by the Company.

23. The user is fully responsible for protecting his username and password for his account on the online store, as well as for all actions performed by him or by a third party using the username and password.

VI. ORDERS

24. The User has the right to order all products listed on the online store. When placing the order, the User has the right to choose the type and quantity of the products and method of payment, according to the options offered on the website.

25. At any time before the final confirmation of the order by pressing the confirm button, the User has the right to make changes in the selected products.

26. The request is considered submitted after clicking on the button "I agree with the terms abd conditions" and clicking on the button "Complete the order". Completion of the order by pressing the appropriate button is legally binding: by submitting the application the User declares his explicit consent to accept an email confirmation of the order sent to him by the Company to provide information and confirm the contract.

27. The company sends an e-mail confirming the order or notifying him of the lack of the products.

28. The sending of the order by the User and the confirmation of the specific order by the Company are the conditions under which the contract for purchase and sale of goods from the online store www.gora.eco is considered concluded. The sending by the Company of confirmation of the specific order binds the company and the User from the terms of the contract and the terms of these Terms and Conditions, as well as the relevant provisions of the Consumer Protection Act.

29. The Company has the right to change the prices indicated on the site, at any time without being obliged to notify the Users in advance. The user is obliged to pay the price indicated on the site during the order, regardless of whether it is lower or higher than the updated price. In case of technical errors in the information published on the site, as a result of which the order cannot be executed, The Company has the right to refuse the order and does not owe any compensation to the user, except refund of amounts paid and/or deposited by the User for the canceled order.

VII. PAYMENTS

30. The consumer can pay the price of the ordered goods through:

- Bank transfer, by debit or credit card

- Cash on Delivery

By accepting these General Terms and Conditions, the consumer gives his explicit and unconditional consent to pay in advance to the Company the entire sale price of the ordered goods.

31. In case of chosen method of payment "Cash on delivery" the User undertakes to pay at the time of delivery to the courier making the delivery, the full value of the goods, together with the price for delivery of the goods specified in the order, according to these General Terms.

32. In case of selected method of payment "Bank transfer - by debit or credit card", the User pays the full amount at the time of order confirmation.

VIII. SHIPPING & DELIVERY

34. For orders over BGN 100, the delivery in Bulgaria is free.

35. The delivery term of the ordered goods is up to 5 (five) working days for the territory of the Republic of Bulgaria, after receiving confirmation of the order.

36. The delivery term of the ordered goods abroad is up to 20 (twenty) working days after receiving the confirmation of the order.

37. The delivery term may be extended on public holidays and/or weekends with the term of non-working days.

38. The User agrees that it is possible to extend the above delivery period due to unforeseen circumstances beyond the control of the Company.

39. The delivery is made:

- For the territory of the Republic of Bulgaria - through courier company Speedy, to an office or to an address chosen by the User.

- Abroad - through a courier company, with a tracking number, to an address specified by the User.

40. The Company is not responsible for inaccurate and/or delayed order, , when it is the fault of the courier/transport company and/or incorrect or incomplete address, contact person and/or telephone number indicated by the User, as well as for others, independent of Company circumstances.

41. Upon receipt of the products, the User or the third party indicated by him have to sign the accompanying documents. User is considered to be any person who is not the holder of an order but accept the delivery order at the delivery address specified by the consumer.

42. In case the User is not found within the delivery term to the address indicated by him and/or access to the delivery address is not provided, the contract shall be considered terminated and the company shall be released from its obligation to deliver the ordered goods and the User loses his rights under the order made by him for delivery of goods.

IX. RISK TRANSFER

43. The risk of loss or damage of the goods passes to the User at the moment when he or the third party, other than the courier and indicated by the consumer, accepts the goods.

X. RETURN OR EXCHANGE

RETURN

44. The User has the right to return the purchased goods within 14 days without stating a reason, without paying compensation or penalty, from the date of acceptance of the goods by the User or a third party other than the courier and specified by the User.

45. When the User wants to refuse and return the order, it is necessary to inform the Company before the expiration of the 14-day period. For this purpose, the User should write to e-mail: sales@gora.eco, after which he will receive a Return Form. The form is filled in by the User and sent to the Company, together with the returned products within the above period. In the Return Form the User is obliged to indicate the bank account and the account holder to which the Company should refund the amount.

46. The goods should be returned to the Company in the condition in which it was delivered to the User or to the third party specified by the User. The User is responsible for returning the products in the perfect condition.

47. The returned products within the above term shall be accepted by the Company only if the following conditions are simultaneously fulfilled:

- The products are in the original packaging;

- All labels are attached to the product;

- The products are not used, soiled or damaged;

48. The User has the right to inform the Company about his refusal from the contract and by sending a notice for exercising his right of refusal to the e-mail of the Company within 14 days of receipt of the goods. The user is obliged to indicate the bank account and the account holder to which the Company should refund the amount paid. After receiving the message, the Company sends an email to the User - a message confirming that he has received an email to return the goods. All other conditions for returning the goods listed above apply in this case as well.

49. The refund is made within 14 days of receipt of the return form and receipt of the goods by the Company, and when the User has exercised his right of withdrawal by e-mail, after receipt of the goods by the Company. The refund is made only to the bank account specified by the User.

50. The costs of returning the goods are at the expense of the User.

51. Until the moment of delivery of the returned goods to the Company, the risk of loss or damage is borne by the User.

EXCHANGE

52. The User has the right to replace the goods already delivered to him and to receive identical to the returned goods within 14 days from the day of delivery of the goods. The user is obliged to indicate the reasons for the requested replacement. In order to replace the received goods, the User should state his wish in writing to e-mail: sales@gora.eco, after which he will receive a Exchange Form. The form is filled in by the User and sent to the Company, together with the returned goods within the above period.

53. The exchange of goods is carried out according to the conditions of an ordinary order.

54. In case the Company does not have a product available to replace the returned goods and the User does not want to replace the returned goods with another, the Company undertakes to refund to the User the value of the goods by him within 14 days, to a bank account specified by the User.

55. The costs for the exchange of the goods are at the expense of the User.

XI. COMPLAINTS

56. The consumer has the right to make complaints to the Company within 14 days of receipt of the goods. Complaints are submitted to the e-mail of the Company /sales@gora.eco/. When filing a complaint, the User undertakes to indicate the subject of the complaint and provide a bank account to which the amount paid for the goods will be refunded, in case the User refuses to replace the goods with another.

57. Upon submission of a complaint to the User refusal application and documents in which the claim is based:

- Goods receipt or invoice;

- Documents establish non-compliance of the goods with the agreed.

58. The costs for returning the advertised goods are at the expense of the Company. The Company notifies the User within 2 / two / working days before sending a courier to the User's address for shipment of the goods. The consumer is obliged to hand over the advertised goods to the courier.

59. The complaints of the Users shall be considered and resolved within the terms and conditions of the Consumer Protection Act.

XII. RIGHTS AND OBLIGATIONS OF THE COMPANY

60. The Company has the right at any time, without notifying the User, when the latter uses the services in violation of these Terms and Conditions, and at the discretion of the Company to terminate, suspend or change the services provided in connection with the use of the site.

61. The Company is not responsible if for any reason (technical or other) the User does not have access to the site at any time.

62. The Company shall not be liable for damages caused within the software, hardware or telecommunication facilities, or loss of data produced from materials or resources, searches, downloaded or used in any way in which the services are used.

63. The Company shall not be liable for non-fulfillment of the obligations under this contract upon entering into circumstances, which they did not foresee and were not obliged to foresee.

64. Every quarter the company provides to the GORATA.BG Foundation the amount corresponding to the number of trees indicated in goraclothing.com (the site) for each single product purchased by a client. The value of the funds provided to the gorata.bg foundation for each individual product does not exceed 10% of the value of the product.

XIII. RIGHTS AND OBLIGATIONS OF THE USER

65. The User has the right to be informed about the status of his order.

66. The User is responsible for the protection of his username and password, as well as for all actions performed by him or by a third party through the use of the username and password. The User is obliged to immediately notify the Company of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use.

67. The User is obliged to pay the price of his order according to the way announced on the goraclothing.com website.

68. Every User, regardless of whether he is a client of the Company, is obliged when using the services:

- Not to violate and respect the fundamental rights and freedoms of citizens and human rights, according to the Constitution and the laws of the Republic of Bulgaria and the recognized international acts;

To immediately notify the Company of any case of committed or discovered violation when using the provided services;
Do not download, send, transfer, distribute or use in any way and do not make the status of third parties software, computer programs, files, applications or other materials containing computer viruses, unauthorized remote control systems, computer codes or materials designed to interrupt, close, disrupt, or restrict the normal functioning of computer hardware or software or telecommunications equipment or intended to gain unauthorized access to or access to foreign resources or software.

69. The User is obliged to indicate an accurate and valid telephone number, delivery address and e-mail address, to pay the price of the goods, to pay the delivery costs when the same is not free and to provide access and opportunity to receive the goods.

XIV. FINAL PROVISIONS

70. When using the online store goraclothing.com, the Users are obliged to comply with these Terms and Conditions.

71. All disputes arising during or in connection with the interpretation and/or implementation of these Terms and Conditions will be resolved by agreement between the parties, and in case of impossibility to achieve such, by the competent Bulgarian court.
